Creative Fabrica does not guarantee a minimum or maximum number of items, nor does Creative Fabrica guarantee that items that are available right now, will remain available in the future.

SECTION 3 – LICENSE

When you purchase a product on 3dsvg.com, you purchase a personal license, as well as a limited commercial license to use that SVG.

Restrictions and Limitations: Actual digital SVG and PDF files from 3dsvg.com cannot be sold or distributed in their original digital form or any modified form (including digital embroidery files). Commercial use is defined as using the digital design in any physical project, product, artwork, etc. intended for resale. You can cut our files out of any medium (paper, vinyl, chipboard etc) and use them on products for sale (pre-made cards, scrapbooks, vinyl projects, party decor). We do not allow the sale of pre-cut kits for assembly by the customer. All items for sale must be completely assembled. You may sell products made using our cuts both physically (e.g., in your store, market stall, or cabana) and online, whether through your own website, domain, or e-commerce platform, as well as on online marketplaces like Etsy. Official photos from 3dsvg.com cannot be used to market your products. You must take your own photos.

SECTION 4 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if the information made available on this site is not accurate, complete or current. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. You may never resell or redistribute the digital source files unless explicitly stated, you received written permission from Creative Fabrica. When deliberately breaching this clause, you agree that this will result in a $500 fine per breach, with a minimum fine of $10000.

You agree to respect the license agreement associated with your account. This license will remain active forever, even after cancellation of your account or our cancellation of the service.

SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

SECTION 16 – OWNERSHIP

When you purchase a digital download you purchase 1 single license for up to 3 of your devices unless your license states otherwise. This license, called the 3DSVG.com License and can be found under SECTION 3 of these Terms, grants you the right to use the files, but you never buy the full rights and ownership over these files. We are allowed to retroactively update the terms and conditions of our Creative Fabrica License and apply this to past and future purchases.

SECTION 17 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 18 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
